Terms and Conditions – Candidates

These Terms and Conditions (the "Terms") govern the use of the Africa AI Talent Agent service ("Africa" or the "Service") by candidates who participate in an interview to apply for a job.

2. What the Service Is
Africa is an artificial intelligence agent that conducts interviews via messaging (e.g., WhatsApp) to collect application information and provide companies with a transcript and/or summaries and/or suitability assessments based on the conversation, with the aim of improving the candidate experience and helping manage applications in a more semantic way.
3. What the Service Is NOT
- Africa does not make binding automated decisions about applications. Africa does not decide whether a candidate "passes" or "fails".
- Africa does not guarantee that the company will conduct a human interview or that the candidate will obtain employment.
- Africa is not a legal, employment, or immigration advisory service.
4. Usage Requirements
Minimum age: 18 years.
If you do not meet this requirement, you must not use the Service.
5. How It Works
- You access the Service through a link provided by the company or an authorized third party.
- You complete an interview via chat and/or audio (if you send audio, it is transcribed).
- Before sharing your information with the company, the Service will request your consent to do so (according to the conversation flow).
- You may request deletion or rectification by writing to the same messaging account used for the interview.
6. Your Responsibility and Conduct
You agree to:
- Provide truthful information and not impersonate others;
- Not send illegal, offensive, discriminatory content or content that infringes third-party rights;
- Not interfere with, scrape data from, or abuse the Service.
We may restrict or block access in the event of abusive or fraudulent use.
7. Content You Provide and License
You retain ownership of the rights to the content you provide (e.g., your answers or your CV).
You grant us a non-exclusive, limited license to:
- Process your information to provide the Service,
- Generate transcripts and summaries,
- Share them with the company only for the position you are applying for, in accordance with your consent and the Privacy Policy,
- And, only if you give specific opt-in consent, use your profile to suggest future opportunities.
8. AI, Errors and Limitations
AI may make mistakes, omissions, or imperfect interpretations. The Service is provided "as is" and:
- We do not guarantee total accuracy of transcripts/summaries;
- The company must verify the information and conduct its own human interviews and checks;
- We are not responsible for decisions made by third parties (e.g., the company).
9. Service Availability
We may modify or interrupt the Service for maintenance, security, or technical reasons. We will try to minimize impact, but we do not guarantee continuous availability.
10. Third-Party Links and Services
The Service may integrate with third-party platforms (e.g., WhatsApp Business Platform) and technical providers. Your use of those services may be subject to their own terms.
11. Privacy
The processing of personal data is described in the Privacy Policy.
12. Changes to These Terms
We may update these Terms. If the change is significant, we will indicate it in the "last updated" date.
13. Applicable Law and Jurisdiction
These Terms are governed by Spanish law. For any dispute, unless otherwise required by mandatory law, the courts of Valencia (Spain) shall have jurisdiction.
Terms and Conditions – Companies

These Terms apply to companies or representatives that use Africa to receive applications.
1. Parties
Service Owner: Juan Castillo Capital S.L.U. (details in the Privacy document).
User Company: the entity that integrates the link or requests the Service.
2. Purpose
Africa provides a messaging-based interview channel for candidates and delivers to the Company, according to configuration and candidate consent:
- Transcript,
- Summary,
- And/or "suitability assessments" based on the conversation.
3. No Automated Decisions
The Company acknowledges and accepts that:
- Africa does not make automated decisions nor issue a hiring verdict.
- The Company is solely responsible for its own processes, human interviews, verifications, and decisions.
4. Company Obligations
The Company agrees to:
- Use the information received only for selection purposes related to the corresponding job offer, in compliance with applicable data protection legislation;
- Not reuse candidate data for marketing or other purposes without its own legal basis;
- Not request or process sensitive data unless there is a legal basis and reinforced safeguards.
5. Representation and Verification
We may request reasonable evidence to verify that the applicant represents the Company and is authorized to use the Service.
6. Confidentiality and Security
The Company must protect the information received with reasonable measures and limit internal access to personnel involved in the selection process.
7. Liability
To the maximum extent permitted by law:
- We do not guarantee complete accuracy of outputs;
- We are not liable for the Company's decisions or indirect damages;
- Total liability, if any, shall be limited to the amount actually paid by the Company to the Owner in the preceding 3 months (if the Service were paid). The Service is currently free of charge.
8. Law and Jurisdiction
Spanish law and the courts of Valencia (Spain), unless otherwise required by mandatory law.
